Plagiarism

Accusations of plagiarism are a recurring theme in fan fiction communities. They bring up issues such as what to do with guilty parties, how archivists should handle it, feelings of being plagiarized, why people plagiarized, and if fan fiction is itself nothing but plagiarism. Indeed, there are issues which the fan fiction community simply cannot resolve involving plagiarism because of the legally nebulous area that fan fiction occupies: there is no remedy if some one is found guilty of plagiarising in fan fiction. [1]
The fan fiction community has traditionally treated the copyright issue as a legal issue and the plagiarism issue as an ethical issue. This is an important distinction both historically and culturally in how the fan fiction community approaches the issue.
This is supported by copyright law. Nowhere in Title 17 of the United States Code is the word plagiarism used. Offering legal defenses for plagiarism or condemning plagiarism for its illegality is thus moot. Plagiarism can be part of copyright infringement but it is, in and of itself, not necessarily infringement. It is not relevant to the discussion.
Below is a timeline of some plagiarism related fan fiction events.
[edit] Timeline of plagiarism events in fandom
[edit] 1997
- In early July of 1997, there was a kerfluffle on alt.tv.x-files.creative regarding plagiarism and the policies of the Gossamer archivists in how they dealt with those accusations.
- In November 1997, H. L. Moore, an X-Files fan fiction writer, had her story "Forgiven" plagiarized by a Silk Stalkings author. [2] The same Silk Stalkings plagiarist also stole Kipler's "How the Grinch Stole R'Hood."[3]
- In December 1997, alt.tv.x-files.creative had another debate regarding what is and is not plagiarism. The thrust of one argument that fan fiction itself is plagiarism so when some one steals word for word some one else's work, it isn't so much plagiarism as it is copying. There was much disagreement over this. The major participants in this discussion included Marianne, Elixia, Kipler, Dawson E. Rambo, MSR XFiles, Phetsy Calderon, Circe and Patricia S. Martinez. [4]
[edit] 1998
- On April 24, 1998, it was discovered Anya plagiarized Jennifer Wand's Sailor Moon fan fiction. [5]
- The FAQ for alt.tv.er.creative published in October 1998 specifically mentions plagiarism, demonstrating that this behavior is not to be tolerated when it says:
- I've been asked to say something about plagiarism so OK, here goes. First up, IT IS ABSOLUTELY UNACCEPTABLE TO DELIBERATELY COPY THE WORK OF ANOTHER AUTHOR. Plagiarism is wrong, pure and simple. Don't do it. [6]
[edit] 1999
- Around February 1999, an author calling herself "Naughty Nanny" plagiarized Star Trek, X-Files and Lois and Clark stories and changed them to The Nanny stories. [7] One of the authors who was plagiarized was Ilsa, a Star Trek fan fiction writer. [8] Another author plagiarised was the Star Trek fan fiction writer, imz. [9] [10] Another author plagiarized was Ruth Gifford. [11]
- Around July 1999, Fortune Amethyst Macaire plagiarized several Forever Knight stories and turned them into Buffy: The Vampire Slayer stories. Included in the authors plagiarized by Fortune Amethyst Macaire were Nightlady, Sue Clark, Texasbrat, Mistress V, Caroline LaRoche, April Ruskin, Shelia Turner, Carrie Krumtum, Lilywhite Lilith, Tyra and Debra Ann. [12]
- In August 1999, Missy Pennington discovered that and "archive has almost 200 stories and 169,000 hits, and "Hardball" was obviously one of the first stories archived there." These stories were taken word for word from English stories and translated to Spanish and posted as written by the translator. [13]
- Around November 1999, JosieChung's X-Files stories were plagiarized and posted to a La Femme Nikita sited called Storyboard I. [14]
[edit] 2000
- In August 2000, the website FanfictionCentral.net was accused of plagiarizing a fan fiction guide written by The Outer Senshi Trio of Tim Nolan, Amanda Anderson, and Jackie Chiang; the site was said to have quoted large chunks of material without citing the original source. Anderson later reported that the matter had been settled to their satisfaction. [15]
- Late September saw one of the early instances of Cassandra Claire having her work copied. An author had posted Cassandra Claire's work to FanFiction.Net under the name Cassandra C1aire. This was reported by Heidi8 and Cassandra Claire. The story was removed from FanFiction.Net because of the plagiarism and misrepresentation of the author. [16]
[edit] 2001
- On May 14, 2001, the Harry Potter fan fiction community that surrounded Cassandra Claire became aware that a thirteen year old author was plagiarizing Cassandra Claire on FanFiction.Net. Cassandra Claire's fans were appalled that some one would plagiarize Cassandra Claire. [17][18][19][20][21][22][23][24][25] Cassandra Claire's fans were leaving her reviews that could be construed as harassing because the author plagiarized their favorite author, Cassandra Claire. Cassandra Claire told the members of ParadigmOfUncertainty "I also agree with the people who say to give this kid a break -- she's only 13 -- and like I said, I'll deal with it. ;)" [26] and offered a "cookie" for one of the chapters for her stories. Cookies are short extracts of a story or chapter, designed to entice the reader to read the fic. Notice the behavior pattern: Cassandra Claire's fangirls were being extremely mean and harassing. Cassandra Claire was made aware of her fans' behavior. Rather than clearly tell them to stop, she offers one throw away line and then tries to make everyone feel better. This type of behavior foreshadows the events of Charity Wank where the fans are not told to back off and stop behaving badly. Interestingly, this would have been a good time for Cassandra Claire to discuss her own borrowing found in her stories as it made for a good parallel with the current situation.
- On June 22, 2001, Cassandra Claire was kicked off FanFiction.Net for plagiarizing Pamela Dean. It would later come out that she had plagiarized extensively from more sources than just the one that got her kicked off FanFiction.Net.
[edit] 2002
- Around July 2002, Cryst98014 discovered that her X-Files story, "Ribbed: For Her Pleasure" was plagiarized by a Buffy: The Vampire Slayer author named Denna. Another Buffy: The Vampire Slayer or a sockpuppet of Deanna named Buffybot also plagiarized "all paths lead to you" by AgentXsley. Apparently the author responded on an X-Files mailing list saying that she was just doing it for laughs and in tribute to her favorite author, Judith Viorst. [27]
- Around October 2002, it was discovered that LittleOni plagiarized two Tenchi Muyo authors, Diane Long and Hospitaller. LittleOni also plagiarized a Sailor Moon story. [28]
[edit] 2003
- In late October 2003, alt.tv.buffy-v-slayer.creative debated what constituted plagiarism. People sought to define it and to answer the question of if you can plagiarized ideas found in fan fiction. People who participated in this discussion included Paul Gadzikowski, Jane Davitt, Peter Meilinger, Darth Spacey, Sam James, and Knights Errant. [29]

- "December 12, 2006: On Ficwad, Inuyonas began a fic also titled Big Bad Hinata. (Screencap here.) He states here that he got the idea from Naruto Central (where Ten Ten’s version is posted). (Screencap here.) The very first part has similarities, including Hinata waking up in an odd mood, dunking her sister’s head in the toilet, and chocking Neji. However, the dialog is done in the writer’s own words. (Other than the line "Remember Neji you are my bitch!!" being remarkably similar to Kagezuchi’s "Remember, Neji, you’re my bitch." Well, similar minus the proper punctuation.) However, after that, the story appears to go its own direction." [61]
[edit] 2007
- In 2007, it came out that a 12 year old published author plagiarized a piece of French Highlander fan fiction. [62] The author plagiarized a story by Fédéric Jeorge titled Des cendres et du vent written in 2001. [63][64]

The detailed original report is here. As Jagwriter indicated, the videos in question not only had many of the same sequences, but also had the watermarks. I contacted Ptftulsa, who did not reply. However, both videos have since been removed. And currently, at least, it does not appear that the videos s/he has on YouTube have watermarked clips. I will add Prftulsa to the list of known plagiarists." [72]
- In late July 2007, CSI Grissom/Sara writers discover that TraceZBullet is still plagiarizing stories on FanFiction.Net. [89] The plagiarism extended beyond the stories but also went so far as to include plagiarizing comments in reply to the story. [90] The reaction against this plagiarism was fueled by feelings relating to the fact that Thamiris has passed away. This means that, in the case of reporting this plagiarism to LiveJournal, it may be more difficult to get it removed as the site's policy may still be "to ignore copyright violations unless the copyright owner is the one making the report." [91]
- On January 7, 2008, t_w_o (a.k.a _nocturn_ and vixe_icons) plagiarized icons from smelltheflowers (a.k.a. raptureicons) and grrliz, posting them on the Livejournal community 0_i_t_y_t_0[92] (the initials stand for "I take, you take"). This involved Alice in Wonderland, The Beatles, Beauty and the Beast, Beyond the Sea, Harry Potter, and I (heart) Huckabee fandoms. Moderator spiralleds had this to say: "This marks the first time we’ve listed a community as a plagiarist. But given that the community is simply a platform by which one person operates, and at least half of the content has been verified to have been plagiarized, it seems like a logical extension." The stop_plagiarism moderators put 0_i_t_y_t_0, as well as Insane Journal's _i_s_i_[93] and Greatest Journal's _i_t_y_t_[94] on their watch list. [95]

- Also on January 21, 2008, ilsaluvsrick plagiarized Scrubs fanfiction from writing partners randomslasher and thuri (aka randomweavers), turning one of their stories into a Heroes fanfiction. Ilsaluvsrick took full responsibility for the plagiarism, removed the story, and posted a public apology. There was a good deal of support for ilsaluvsrick, which prompted moderator spiralleds to say, "I’d also like to add my appreciation of the generousness of the fannish heart. In response to Ilsa’s willingness to accept accountability, there has been a great deal of support for her to stay and to earn back the trust of her community. It’s reactions like these – plagiarists taking full responsibility for their actions and the community being firm, but kind – that make the work of stop_plagiarism worth it."[103]
- On January 29, 2008, Itachi80 (aka KingItachi00) plagiarized Naruto fanvideos from Theo_Art, gejimayo, fioriparty, Axxie and Snowdragon. Magickboxgirl protested her innocence, saying she had never read any of the stories in question. She also told stop_plagiarism, "I did find it very offensive the way this was handled...", adding that she found plagiarism to be abhorrent. In the end, she apologized that it happened and her stories were removed from a number of Tin Man communities. Moderator sevvy_o praised the moderators of the Tin Man communities for their prompt action.[117]
- On April 26, 2008, The Battling Bard posted two Lord of the Rings poems to MyFandoms.com which were "heavily influenced" by a fanfiction written by Terachi Kaishaku. The high degree of influence prompted stop_plagiarism to add The Battling Bard to the list of known plagiarists.[118]

Most of the pictures were taken from the Death Note and Shaman King fandoms. Many of the pieces were traced from the original mangas and altered to "add" an original character, but others were exact copies, without alterations or credit given. The original report[124] stirred up a lively discusson on what constitutes plagiarism in fan art. On June 4, Rensgurl4ever admitted that she traced many pieces of art, and removed the reported images. However, she is still tracing artwork without giving credit to the original artists.[125]

- In June 2008 Bobmin356's story "Sunset Over Britain" was plagiarized by Austinhp91 on Fanfiction.net. The first chapter was posted, and an author's note added shortly afterward explaining that the story was Bobmin356's "Sunset" and could be found at another site.
