Introduction
- A collaborative corpus adopts the "default copyright" if it does not demand any explicit licenses for contributions to it. In other words, contributors retain copyright for their contributions, and by the very act of contributing are assumed to give some sort of non-exclusive license for redistribution. On wikis, it is often assumed that the act of contributing also implicitly gives a license to create derivative works (to refactor) on that wiki site. CommunityWiki
Fan History uses a modified version of this policy. The policy is also based on that of Meatball Wiki and attempts to bring Fan History's copyright policy in line with those of the wiki ohana.
Policy
The copyrights of material on Fan History (the site) are copyright Fan History, the authors, the authors' employers or the current copyright holder. The site does not claim ownership of the content contributed to Fan History. Works are contributed with permission. By submitting content to Fan History for inclusion in its site, you grant Fan History the world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content for the purpose of displaying and distributing such content through Fan History's systems.
Permissions are extended to reasonable use on the world wide web. Permission is granted to reference (link to), but not copy, content on this site unless within the bounds of "fair use."
Additionally, you grant Fan History a non-exclusive perpetual royalty-free universal license to distribute the content in its archives, or distribute the content in a compilation of selected Fan History content. The redistributed material will be timestamped.
The collection and structure of Fan History are copyright Fan History.
Fan History LLC, its agents and contributors to Fan History Wiki reserve the right to make technical edits and derivative edits to the contributed material in the spirit of editing a wiki and being a member of good standing in the wider wiki family.
Neither site nor Fan History take responsibility in determining or verifying authorship of material.
Fan History LLC reserves the right to edit this policy as necessary but will not change the policy to substantially take away or grant additional rights afforded here. Any change in policy will be announced on Fan History's blog and on Fan History Wiki's main page.
Exceptions
There are several exceptions to the above copyright claims. They are as follows (and Fan History LLC reserves the rights to modify this section as additional exceptions are brought to the attention of Fan History LLC.):
- If a work is not original to Fan History, as is the case for historical documents and images, Fan History does not own those copyrights.
- If a user contributes a work as an essay for protection, they retain the rights for the work and can request that Fan History delete said work at any time but the work must clearly be labeled as an essay and the author has to ask that before submitting or with in some time frame after submitting. Fan History will not republish these essays in any works outside of Fan History but retains the rights to copy these to other servers used by Fan History LLC.
Scope
SEVERABILITY. If any part of this license is found to be unenforceable in any jurisdiction, the remaining portions of the license remain in force.
NO WARRANTY. Fan History works are licensed and provided "as is" without warranty of any kind, express or implied, including, but not limited to, the implied warranties or conditions of merchantability and fitness for a particular purpose or a warranty of non-infringement.
LIMITATION OF EDITORIAL RESPONSIBILITY. The site nor Fan History LLC review any works or material submitted by third parties. The site reserves the right (but not the obligation) in its sole discretion to refuse or remove any works or material that are available via the site's systems. The site and Fan History absolve themselves of all editorial responsibility over the works and material on the site.
JURISDICTION. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Illinois. You hereby consent to the exclusive jurisdiction and venue of courts in Illinois, United States, in all disputes arising out of or relating to the use of Fan History.
Acknowledgments
This policy borrows heavily from Meatball Wiki's copyright policy. Fan History disavows Meatball Wiki from any legal responsibility as a result of Fan History choosing to base our copyright policy on their policy. We understand that by choosing to model our policy on theirs that there is no implication of any relationship being created.
Rationale
Fan History created this policy with the following objectives in mind:
- Create a copyright policy where contributors still own the copyright for the work they have submitted to the wiki;
- Create a copyright policy which allows for people to edit the content submitted as required by the nature of a wiki;
- Create a copyright policy which does not allow people to reproduce the whole of the content elsewhere without the consent of Fan History;
- Create a copyright policy that is in line with the rest of the wiki community so we are good neighbors and members of the great wiki ohana; and
- Surrendering ourselves to a legal jurisdiction which would place the least burden on Fan History LLC.
