Project: A-Kon 2003 - Sunday - Information regarding one of the panels where fans asked authors what they thought of fan fiction. P.N. Elrod was one of several writers on the panel. The following is an extract pertaining to those comments:
- When Elrod was asked if she had a suggestion for those writers, she replied with the story of her experience with a fan who sent her a fan fic based on Elrod's Jack Fleming vampire-detective character. The fan may have thought she was paying a compliment to Elrod, but Elrod was angered, not liking any unauthorized use of her work. The authors noted that fan fic writers have graduated to professional work, but they warned those aspiring authors that never should submit a fan fic to a publisher - and they should avoid any tinge of plagiarism if they want to succeed. Note--the word plagiarism is not used correctly in the above quote. The correct wording in this instance should have been "copyright infringement."
Further information concerning that panel discussion:
Elrod let the audience know that she returned the story to the fan, putting considerable effort into writing a gentle explanation of why she (Elrod) was unable to read it. There is a clause in her contract with her publisher, Ace Science Fiction, covering copyright infringement. Reading the story would open Elrod up to legal repercussions from her publisher, should the publisher find out. As Elrod would rather be writing than dealing with lawyers, it was best to send the story back and not discuss it again.
Elrod thanked the fan for her enthusiasm and hoped she would understand. The fan replied with an apology, stating that she honestly did not know that what she had done was wrong.
Elrod was absolutely satisfied that the fan had indeed made an honest mistake. Many young writers do not understand copyright or have ever heard of it.
Publishing contracts in the USA often contain a clause where, if the author discovers copyright infringement on their work, fan fiction is one example, then they are required to take legal action. If they do not, then the publisher might sue the author. The best course of action, Elrod said, "Stay off the radar. Do not send your fan fiction to the copyright holder. Some don't mind, others do. It is better for you both to not bother them with it."

She maintains she is not anti-fan fiction, just asking that writers not do fan fiction based on her works. The idea is to protect their possible future career as professional writers.
She advises caution to fan fic writers. If they get embroiled in a copyright infringement suit in ANY fandom, it could mess up their chances of making professional sales to publishers later on.
Publishing houses are being especially cautious guarding themselves against copyright infringement, due to various high profile cases lately seen in the media, such as the the J.K. Rowling suit concerning the Harry Potter Lexicon.
Elrod recommends young writers make up their own universe and play in it, as it's less restrictive and more fun than using another's creation--and safer for them.
